1. Acceptance of Terms

By accessing or using the FundedFix platform, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all visitors, users, and contractors who access or use the Service. "You" and "your" refer to the individual or entity using the Service. "We," "us," and "our" refer to FundedFix.

2. Description of Service

FundedFix is a software tool that helps home service and home improvement contractors present estimated monthly payment options to homeowners during the estimate process. The Service is designed to be used at the point of estimate — when a contractor is presenting a project price — to help homeowners understand potential monthly affordability before deciding whether to pursue financing.

FundedFix may also facilitate introductions between homeowners and independent third-party financing providers. FundedFix does not itself provide, originate, underwrite, or fund any financing.

3. FundedFix Is Not a Lender

Monthly payment figures displayed through FundedFix are illustrative estimates calculated using assumed interest rates and loan terms. These figures are not offers of credit, not binding commitments, and not guaranteed. Actual financing terms — including rate, payment amount, fees, and approval — are determined solely by the financing provider after a completed application and underwriting review.

4. Eligibility

The Service is intended for use by home service and home improvement contractors operating in the United States. By using the Service, you represent that you are at least 18 years of age, have the legal authority to enter into these Terms on behalf of yourself or any business entity you represent, and are operating a legitimate contracting or home services business.

FundedFix reserves the right to refuse service to anyone for any reason at any time.

5. Accounts and Registration

To use certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify FundedFix immediately at info@fundedfix.com if you believe your account has been compromised.

You may not share your account credentials with others or allow others to access your account on your behalf without authorization from FundedFix.

6. Permitted Use

Subject to these Terms, FundedFix grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes as a contractor.

Permitted use includes: presenting estimated monthly payment options to homeowners during in-person or remote estimate conversations; using FundedFix-provided tools to illustrate affordability; and facilitating introductions to third-party financing providers where a homeowner expresses interest in pursuing financing.

7. Prohibited Conduct

You agree not to use the Service to:

— Misrepresent estimated monthly figures as guaranteed offers of credit or binding financing terms;
— Present FundedFix estimates in a manner that misleads homeowners about the nature, cost, or availability of financing;
— Violate any applicable federal, state, or local law, regulation, or consumer protection rule, including those governing advertising of credit;
— Reverse engineer, copy, scrape, or attempt to extract proprietary data or source code from the Service;
— Use the Service to transmit spam, malware, or any unauthorized automated queries;
— Sell, resell, sublicense, or transfer access to the Service to any third party without prior written consent from FundedFix;
— Use the Service for any purpose that competes with FundedFix without prior written consent.

8. Payment Estimates and Calculations

Monthly payment estimates displayed through FundedFix are calculated using illustrative interest rates, assumed loan terms, and standard amortization formulas. These estimates are provided for informational and conversational purposes only.

Estimates do not constitute an offer of credit. They do not reflect the homeowner's actual creditworthiness, the specific products available through any lender, actual APR, applicable fees, or final loan terms. Actual monthly payments may be higher or lower than estimates shown.

Contractors using FundedFix are responsible for ensuring that estimates are presented to homeowners in a manner that is clear, accurate, and not misleading. Contractors must make clear to homeowners that figures are estimates only and that final terms are determined by the financing provider.

9. Third-Party Financing Providers

FundedFix may connect homeowners or contractors with independent third-party financing providers. These providers operate under their own terms, conditions, privacy policies, and lending criteria. FundedFix is not a party to any agreement between a homeowner and a financing provider and has no responsibility for the availability, terms, or performance of any financing product.

FundedFix makes no warranty or representation that any homeowner will be approved for financing, that any particular financing product will be available, or that the terms offered by any provider will be favorable. All credit decisions are made solely by the financing provider.

Your interactions with third-party financing providers are governed by those providers' own terms and policies. FundedFix encourages both contractors and homeowners to review those terms carefully before proceeding with any financing application.

10. Compensation Disclosure

FundedFix may receive compensation from financing partners in connection with referrals made through the Service. This compensation does not affect the estimated monthly figures displayed to homeowners, which are calculated independently using standard amortization formulas.

FundedFix's receipt of referral compensation does not create a duty to recommend any particular financing provider, nor does it constitute financial or lending advice to contractors or homeowners.

11. Intellectual Property

The Service, including all software, design, text, graphics, and other content, is owned by FundedFix and protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you.

You retain ownership of any content or data you submit to the Service. By submitting content, you grant FundedFix a limited, non-exclusive license to use that content solely to operate and improve the Service.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUNDEDFIX DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

FundedFix does not warrant that the Service will be uninterrupted, error-free, or secure, or that any payment estimates will be accurate or that any homeowner will qualify for financing.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUNDEDFIX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING LOST PROFITS, LOST DATA, OR LOST BUSINESS OPPORTUNITIES, EVEN IF FUNDEDFIX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL FUNDEDFIX'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FUNDEDFIX IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

14. Indemnification

You agree to defend, indemnify, and hold harmless FundedFix and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: your use of the Service; your violation of these Terms; your misrepresentation of FundedFix estimates to homeowners; or your violation of any applicable law or third-party right.

15. Termination

FundedFix may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately.

You may close your account at any time by contacting us at info@fundedfix.com. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, and limitations of liability.

16. Governing Law

These Terms are governed by the laws of the State of Louisiana, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Louisiana, and you consent to the personal jurisdiction of such courts.

17. Changes to These Terms

FundedFix reserves the right to modify these Terms at any time. We will notify registered users of material changes by email or by posting a notice within the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
